TERMS AND CONDITIONS FOR USING THE MOBILE APPLICATION

These Terms and Conditions of using the PAKOMAK DOO Skopjes Mobile application are regulating the type of delivering electronic reports, about the type and the quantity of the garbage containers cleaned from the producer.

Based on the monthly reports known by now, according to the Contract for taking obligations and actions for handling garbage, made with PAKOMAK DOO Skopje, PAKOMAK Doo Skopje is making a report that is delivered to the producer who is suppose to pay the same one as it is written in the Contract.

GENERAL RULES

The Access to the application from the producers side contains his approval of these Terms and Conditions. The producer has approved to read these Terms and conditions before starting with the use of this application for delivering monthly reports about the type and quantity of the garbage by package that is released on the marked from his side. PAKOMAK DOO Skopje is keeping the right, at its own risk to change and/or add part or fully these Terms and conditions and at any time the producer accepts that he has red these Terms and Conditions and that he has approved them. The notification about any change and/or addition to these Terms and Conditions, will be announced on the Pakomak DOO Skopje website and in the Terms and Conditions on the app itself. By agreeing and using of the above mentioned Terms and Conditions by the producer, it is considered that he agrees with them and in the same time is obligated to act accordingly to the changed and/or expanded Terms and Conditions.

If there isn't contract on paper between both sides, the producer doesn't have the right to use this application and to pass it to a third person and the same application is a subject of any kind of restriction of use, established by PAKOMAK DOO Skopje.

With the delivery of the data about the type and quantity of garbage per package released in the marked by the producer, it is considered that the producer has fully agreed these Terms and conditions and has accepted them, in contradiction to that he is not obligated to deliver the needed data for the monthly reports by this way only. In that case the producer can deliver the needed data by letter or by e-mail.

The producer is compliant that the use of this mobile application is only in the way of fulfilling the producers obligations contained in the Law for handling and packaging garbage by package and the Agreement, to take account for the total monthly package that he has released on the market and to deliver those informations in the form of a monthly report to PAKOMAK DOO Skopje.

Although PAKOMAK DOO Skopje, is giving maximum efforts for fast and efficient functionallity of the application, in case of unexpected behaviour that exceeds the control of the workflow of PAKOMAK DOO Skopje, the producer is compliant with the fact that PAKOMAK DOO is excluded from any kind of responsibility if it comes to lose of data information in the process of transfering the informations or short-time maintenance of the application.

ACCESS TO THE APPLICATION

The producer cannot lend, license or sell the content of this application on any kind of third party, before there is an written approval from PAKOMAK DOO Skopje. The producer does not have the right to distribute the content of this application in any kind of way to any kind of third party or unauthorized user.

The producer therefore accepts that the whole content of this application is in the property of PAKOMAK DOO Skopje and that nothing contained in this Terms and Conditions cannot implicate any kind of possibility of transfering the ownership of this application to the producer.

The author rights of the making of this application are fully a property of PAKOMAK DOO Skopje and are exposed to appropriate protection by the positive laws and rules of Republic of Macedonia.

AUTHORIZED USAGE OF THE APPLICATION

The content of this application is meant to deliver the needed information about the type and quantity of the garbage per package that is released on the market by the producer. The delivery of the information, the make of the report and its payment is done according the Contract. The producer or the authorized person by him is delivering on time, complete and correct informations to PAKOMAK DOO Skopje. The delivery not on time, incomplete and incorrect information done by the producer or a person authorized by him is responsibility of the producer and the authorized person by him.

GUARANTEE AND RESPONSIBILITY

The producer is guaranteeing that only authorized people will have authorized access to this application.

The producer is guaranteeing that he will not change, suspend or to make unusable any functionality of this application.

The producer is taking uponhimself that he will face all of the consiquences and will be on PAKOMAK DOO Skopjes site in all of the charges that are against PAKOMAK DOO Skopje, in case of not on time, incomplete and incorrect informations or in case of acting oposite of these Terms and Conditions.

The producer will obligate all of his employees that have access to this application to be guided and to follow these Terms and Conditions.

GENERAL TERMS

These Terms and Conditions are a part of the Contract

For everything that is not forseen and written in these Terms and Conditions, the Law and the Agreement are applied.

By accepting these Terms and Conditions, it is considered that the producer is familiar with its content and is compliant with them.

Any kind of nonaction by PAKOMAK DOO Skopje in terms of the producer taking responsibility for not following these Terms and Conditions will not mean removing the producers responsibility, nor dissability of PAKOMAK DOO Skopje to ask fulfilment of them in future.

These Terms and conditions are on english. If they are accepted on any other language, the version on Macedonian is supperior in the conflict between the sides or in case of problems in the translations.

LEGAL REGULATION

The titles of the Headers used in these Terms and Conditions for using the application are only oriental and do not affect in any kind the content that is within them.

If the court finds that any regulation in these Terms and Conditions is invalid, that will not affect the validity and the importenance of the other regulations in these Terms and Conditions. The legal disputes that can happen as a consiquence of using this application are in competence of the court in Skopje and are solved according to the rules in RM. By using this application, the producer is compliant that any kind of law conflict or request that will come upon is either connected to these Terms and Conditions including their implementation is in competence to the court in Skopje.

TERMS AND CONDITIONS FOR USING THIS APPLICATION

These Terms and Conditions for using PAKOMAK DOO Skopjes application are regulating the way of delivering electronic monthly reports, about the type of garbage and its quantity per package released on the marked from the producer. Based on these reports, accordingly to the Contract for taking responsibility about handling garbage per package, made with PAKOMAK DOO Skopje, PAKOMAK DOO Skopje is making a report that is delivered to the producer and that the producer is obligated to pay for.

The access to the application by the producer has his compliance about the content of these Terms and Conditions. The producer accepts that he has red all of the content within these Terms and Conditions and that is compliant to them. The producer is compliant to read these Terms and Conditions before starting wit hthe use of this application for delivery of the monthly reports about the type and quantity of the garbage released on the marked by the producer. PAKOMAK DOO Skopje holds the right, to change and/or expand fully or just parts of these Terms adn Conditions at any time. The notification about changes and/or expansions of these Terms and Conditions will be shared on PAKOMAK DOO Skopjes website and in the rules and terms for usage of the application in the application. By accepting and further usage of the so changed and/or expanded Terms and Conditions by the producer, it is considered that he is compliant to them and that in the same time he is obligated to act according to the so changed and/or expanded Terms and Conditions. If it is not stated on papers between the sides, the producer does not have the right to use this application or to pass it to a third person which is in any kind restricted of usage, established by PAKOMAK DOO Skopje. With the delivery of the information about the type and quantity of the garbage per package released on the market by the producer, it is considered that the producer is fully compilant and accepts these Terms and Conditions, otherwise he is not obligated to deliver the information about the monthly report on this type of way. In that case the producer can deliver the needed information in written form or by email. The producer is compliant that the use of this application is only in the way of fulfilling the producer obligations contained in the Law for handling with packing and handling garbage by packaage and the Contract, to make monthly evidention about the total package that he has released on the marked in RM and to deliver these evidentions in a form of monthly report to PAKOMAK DOO Skopje.
